Terms of Service – Sudoku Pulse

1. Acceptance of Terms

Welcome to Sudoku Pulse (“the App”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of the Sudoku Pulse mobile application developed and published by Privy Central.

By downloading, installing, accessing, or using Sudoku Pulse, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Age Requirement: You must be at least 13 years old to use Sudoku Pulse. If you are under 18, you must have permission from a parent or legal guardian to use the App.

2. Description of Service

Sudoku Pulse is a Sudoku puzzle game with AI-powered coaching and progression features, including:

• Classic Sudoku gameplay with adaptive difficulty
• AI-powered coaching insights based on your play patterns
• Personalised challenges and smart hints that teach solving techniques
• Experience points (XP) and leveling system
• Achievement tracking and unlocking
• Daily challenges and streak tracking
• Statistics and personal insights dashboard
• Optional Apple Game Center integration for leaderboards
• Local data storage and offline play

2.1 AI Coaching Features

Sudoku Pulse includes optional AI-powered features that analyse your gameplay patterns to provide personalised coaching insights. When AI Insights is enabled in Settings, anonymous gameplay data (move patterns, timing, strategy, game outcomes) is sent to Anthropic's Claude AI service (privacy policy) for processing. No personal information is included. These features can be disabled at any time in Settings → AI Coach. See our Privacy Policy for full details.

The App is currently provided free of charge. We reserve the right to introduce paid features or in-app purchases in the future with reasonable notice.

3. License to Use

3.1 Grant of License

Subject to your compliance with these Terms, Privy Central grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for personal, non-commercial entertainment purposes

3.2 License Restrictions

You agree NOT to:

• Copy or distribute the App except as permitted by the App Store
• Modify, reverse engineer, decompile, or disassemble the App or any part thereof
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use the App for commercial purposes without written permission
• Create derivative works based on the App
• Rent, lease, lend, sell, or sublicense the App
• Use automated tools (bots, scripts, cheats) to interact with the App
• Attempt to gain unauthorized access to any part of the App or its systems

3.3 Apple App Store Terms

If you downloaded Sudoku Pulse from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Privy Central, not Apple
• Apple has no obligation to provide support services for the App
• Apple is not responsible for addressing any claims relating to the App
• You comply with Apple's Media Services Terms and Conditions
• Apple is a third-party beneficiary of these Terms

4. User Account and Game Center

4.1 No Registration Required

Sudoku Pulse does not require account creation or registration for basic gameplay. All game progress is stored locally on your device.

4.2 Optional Game Center

You may optionally connect to Apple Game Center for leaderboards and achievements. Game Center use is subject to:

• Apple's Game Center Terms and Conditions
• Apple's Privacy Policy
• Your Apple ID account status

You are responsible for:

• Maintaining the security of your Apple ID
• All activities that occur under your Game Center account
• Complying with Game Center community guidelines

5. User Conduct

You agree to use Sudoku Pulse in accordance with these rules:

5.1 Prohibited Conduct

• Cheating: Using hacks, mods, exploits, or automated tools to gain unfair advantages
• Fraud: Manipulating leaderboards, achievements, or game mechanics through unauthorized means
• Harassment: Using Game Center features to harass, threaten, or abuse other users
• Impersonation: Impersonating other users, developers, or entities
• System Abuse: Attempting to disrupt, damage, or impair the App's functionality
• Data Mining: Extracting data from the App for unauthorized purposes
• Illegal Activity: Using the App for any illegal or unauthorized purpose

5.2 Fair Play

We encourage fair play and legitimate achievement. If you're found to be cheating or manipulating game systems, we may:

• Reset your progress or statistics
• Remove you from leaderboards
• Revoke achievements
• Terminate your access to Game Center features

6. Intellectual Property

6.1 Ownership

Sudoku Pulse and all its contents, features, and functionality (including but not limited to software code, game mechanics, graphics, user interface, audio, text, and design) are owned by Privy Central and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Trademarks

“Sudoku Pulse” and the Sudoku Pulse logo are trademarks of Privy Central. You may not use these trademarks without prior written permission.

6.3 Sudoku Game Rules

The classic Sudoku puzzle format and rules are in the public domain. Our implementation, puzzle generation algorithms, and game features are proprietary to Privy Central.

7. User Content and Data

7.1 Your Data

You retain ownership of your gameplay data, including:

• Puzzle progress and solutions
• Statistics and performance data
• Settings and preferences
• Achievement progress

7.2 Data Storage and Processing

Your game data is stored locally on your device. We do not have access to or control over your local game data.

When AI Insights is enabled, anonymous gameplay patterns are sent to Anthropic's Claude AI for processing. This data is processed transiently to generate coaching insights and is not stored permanently by us or Anthropic. The AI service retains API inputs for a maximum of 30 days for safety monitoring under its commercial terms. No personal information is included in this data.

7.3 Feedback

If you provide feedback, suggestions, or ideas about Sudoku Pulse, you grant us a perpetual, worldwide, royalty-free license to use, modify, and incorporate such feedback without compensation or attribution.

8. Updates and Changes

8.1 App Updates

We may release updates to Sudoku Pulse from time to time, including:

• Bug fixes and performance improvements
• New features and gameplay enhancements
• Security patches
• Compatibility updates for new iOS versions

Updates may be required to continue using certain features or Game Center integration. We recommend enabling automatic updates in your device settings.

8.2 Changes to Terms

We may modify these Terms at any time by:

• Posting updated Terms on this page
• Updating the “Last Updated” date
• Notifying you through the App (for material changes)

Continued use of Sudoku Pulse after changes constitutes acceptance of the updated Terms.

8.3 Service Changes

We reserve the right to:

• Modify or discontinue features
• Change game mechanics or progression systems
• Adjust difficulty levels or puzzle generation
• Add or remove Game Center integration

9. Termination

9.1 Termination by You

You may stop using Sudoku Pulse at any time by:

• Deleting the App from your device
• Disabling Game Center integration in Settings

9.2 Termination by Us

We may terminate or suspend your access to Sudoku Pulse or Game Center features if:

• You violate these Terms
• You engage in prohibited conduct
• Required by law or legal process
• Necessary to protect other users or the integrity of the App

9.3 Effect of Termination

Upon termination:

• Your license to use the App immediately ends
• You must stop using the App and delete it from your devices
• Local game data may be retained on your device unless you delete the App
• Game Center data remains subject to Apple's policies

10. Disclaimers and Warranties

10.1 No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRIVY CENTRAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness
• Uninterrupted or error-free operation
• Freedom from viruses or harmful components

10.2 Use at Your Own Risk

You acknowledge and agree that:

• You use Sudoku Pulse at your own risk
• We do not guarantee the App will meet your requirements
• Gameplay, features, or progression systems may change
• Bugs, errors, or technical issues may occur
• Data loss may occur (we recommend regular device backups)

10.3 Third-Party Services

Game Center and other Apple services are provided by Apple, Inc. We are not responsible for the availability, functionality, or reliability of these third-party services.

11. Limitation of Liability

11.1 No Liability

IN NO EVENT SHALL PRIVY CENTRAL, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Loss of goodwill or reputation
• Business interruption
• Personal injury or property damage
• Data loss or corruption

This limitation applies whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

11.2 Maximum Liability

IF WE ARE FOUND LIABLE DESPITE THE ABOVE LIMITATIONS, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY. SINCE THE APP IS CURRENTLY FREE, THIS AMOUNT IS $0.00.

11.3 Jurisdictional Variations

Some jurisdictions do not allow certain limitations on liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Privy Central, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations
• Your use of Game Center or Apple services

13. Governing Law

13.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

13.2 Jurisdiction

You agree to submit to the personal and exclusive jurisdiction of the courts located within New Delhi, India for the resolution of any disputes.

13.3 Apple Provisions

Notwithstanding the above, Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a legal claim, you agree to first contact us at support@privycentral.com to attempt to resolve the dispute informally. We will work with you in good faith to reach a resolution.

14.2 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration rather than in court, except that:

• You may assert claims in small claims court if they qualify
• Either party may seek injunctive relief in court for intellectual property infringement

14.3 Class Action Waiver

YOU AND PRIVY CENTRAL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Privy Central regarding the use of Sudoku Pulse.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms at any time without notice.

15.5 Export Compliance

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in a country subject to U.S. government embargo or designated as a “terrorist supporting” country.

15.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, or service interruptions by internet or hosting providers.

15.7 Survival

The following sections shall survive termination of these Terms: Intellectual Property, User Content and Data (feedback clause), Disclaimers, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, and General Provisions.
